Your official rules
OFFICIAL RULES [Sponsor / Streamer Name] — Sweepstakes Official Rules NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED BY LAW. This is a free drafting tool, not legal advice. Review these rules (and have a lawyer review them) before relying on them for a real promotion, especially one with a prize of meaningful value or reach across multiple states or countries. 1. SPONSOR This sweepstakes (the "Sweepstakes") is sponsored by [Sponsor / Streamer Name] (the "Sponsor"). The Sweepstakes is run on or in connection with Twitch. 2. NO PLATFORM SPONSORSHIP This Sweepstakes is in no way sponsored, endorsed, administered by, or associated with Twitch. Twitch is not responsible for this promotion. By entering, you release Twitch from any and all liability related to the Sweepstakes. 3. SWEEPSTAKES PERIOD The Sweepstakes begins on August 7, 2026 and ends on August 14, 2026 at 8:00 PM (the "Sweepstakes Period"). Sponsor's system clock is the official time-keeping device for this Sweepstakes. 4. ELIGIBILITY Open only to legal residents of the fifty (50) United States and the District of Columbia who are at least 18 years of age (or the age of majority in their jurisdiction of residence, if higher) at the time of entry. Employees, contractors, and immediate family members (spouse, parents, children, siblings) or household members of Sponsor are not eligible to enter or win. Void where prohibited or restricted by law. 5. HOW TO ENTER During the Sweepstakes Period, eligible entrants may enter by one or more of the following methods: • Type a keyword or command in chat/comments Limit one (1) entry per person per method, unless otherwise stated by Sponsor. Automated, robotic, or bulk entries are void. 6. NO PURCHASE NECESSARY / FREE ENTRY No purchase, payment, subscription, donation, or other consideration is required to enter or win. Every entry method listed above is free of charge. If Sponsor offers any paid or bonus entry method now or in the future, an equal, no-cost alternative method of entry will always remain available, and paid entries will not receive better odds of winning than free entries. 7. WINNER SELECTION One (1) winner will be selected in a random drawing from among all eligible entries received during the Sweepstakes Period. The drawing will be conducted by Sponsor, or Sponsor's designated representative, after the Sweepstakes Period ends. Odds of winning depend on the total number of eligible entries received. 8. WINNER NOTIFICATION The potential winner will be notified by direct message, chat mention, or the contact information provided at entry, within a reasonable time after the drawing. The potential winner must respond within 7 day(s) of notification and, if requested, complete and return any required affidavit of eligibility, liability release, and (where lawful) publicity release. Failure to respond in time, or failure to meet eligibility requirements, may result in disqualification and selection of an alternate winner in Sponsor's discretion. 9. PRIZE One (1) prize will be awarded: [describe the prize] (approximate retail value: [$ approximate retail value]). Actual value may vary. No cash alternative will be offered unless Sponsor elects to substitute a prize of equal or greater value at its sole discretion, for example if the stated prize becomes unavailable. Prize is awarded as-is, with no warranty of any kind from Sponsor. Winner is responsible for any costs not expressly stated as included in the prize. 10. TAXES Any taxes associated with the receipt or use of the prize are the sole responsibility of the winner. Depending on the prize's value and the winner's country of residence, the Sponsor may be required to collect tax information and issue tax reporting documents. Winners should consult a tax professional regarding their own situation. 11. GENERAL RELEASE / LIMITATION OF LIABILITY By entering, entrants agree to release and hold harmless Sponsor, Twitch, and each of their respective officers, employees, and agents from any liability, injury, loss, or damage of any kind arising from or in connection with participation in this Sweepstakes or the receipt, possession, or use of any prize, to the fullest extent permitted by law. 12. DISQUALIFICATION / MODIFICATION Sponsor reserves the right, in its sole discretion, to disqualify any entrant who tampers with the entry process, violates these Official Rules, or acts in an unsportsmanlike or disruptive manner. Sponsor reserves the right to cancel, suspend, or modify the Sweepstakes, or these Official Rules, if fraud, technical failure, or any other factor beyond Sponsor's reasonable control impairs the integrity of the Sweepstakes, subject to applicable law. 13. VOID WHERE PROHIBITED This Sweepstakes is subject to all applicable federal, state, provincial, and local laws and regulations. Void where prohibited or restricted by law. 14. GOVERNING LAW This Sweepstakes and these Official Rules will be governed by and construed under the laws of Sponsor's jurisdiction of residence, without regard to conflict-of-law principles, except where prohibited by an entrant's local law. Last updated: August 7, 2026. These Official Rules were drafted with a free template and are not legal advice.

Why this matters
A prize giveaway without written rules is a legal gray area
If you are giving away something of real value and picking a winner at random, having clear written rules is a best practice almost everywhere, and it makes disputes with entrants much easier to settle fairly.
Keeps entry free
A no purchase necessary clause and a free entry path help keep your promotion a legal sweepstakes rather than something that looks like a lottery.
Sets clear expectations
Eligibility, dates, and how the winner is picked and notified, all in one place, so entrants know exactly what they signed up for.
Covers the practical stuff
Prize substitution, response deadlines, and a note on taxes, the details that generic contest posts usually skip.
FAQ
Sweepstakes rules questions
What does "no purchase necessary" mean?+
It means anyone can enter without paying, subscribing, or buying anything, usually through a free alternative method of entry (AMOE). In the US, many sweepstakes include this clause because a prize promotion that requires payment to enter can be treated as an illegal lottery instead of a legal sweepstakes. Offering a free way in, with the same odds as any paid path, is the standard way promoters avoid that outcome.
What does "void where prohibited" mean?+
It is standard boilerplate meaning the promotion is not valid in any state, country, or region where running it would break local law. It does not remove your obligation to check the law yourself; it is a disclosure that some places may be excluded from eligibility.
Do I need a lawyer to run a giveaway?+
It depends on the prize and reach. Many streamers and creators self-draft simple rules for a low-value, single-country giveaway using a template like this one. If your prize has meaningful value, your audience spans multiple states or countries, or you are unsure about eligibility or tax questions, it is worth having a lawyer review your rules before you launch.
Do winners pay tax on prizes?+
Generally yes: in the US, prizes are treated as taxable income to the winner at fair market value, regardless of whether the prize is cash, a gift card, or physical merchandise. Depending on the prize value and the winner's country, the sponsor may also have tax reporting obligations. Specifics change over time and vary by country, so this is informational, not tax advice, and winners should check with a tax professional.
Is this generator only for Twitch giveaways?+
No. It is platform-agnostic and works for Twitch, Kick, YouTube, Instagram, Facebook, TikTok, or a giveaway run entirely on your own website. If you specifically want Twitch's Promotions clause and disclaimer requirements explained, see our Twitch giveaway rules guide.
Is this legal advice?+
No. This tool generates a drafting starting point using commonly used sweepstakes clauses. It is not a substitute for advice from a qualified attorney, especially for anything with a prize of meaningful value, multi-state or international reach, or specific legal questions.
What about sweepstakes lawyers or FTC rules I've seen mentioned?+
Sweepstakes and promotion law firms exist because larger, higher-value promotions genuinely benefit from legal review, and the FTC maintains general guidance on lotteries and sweepstakes. For a typical low-value stream giveaway, most streamers use a free template like this one and skip paid legal review; for anything bigger, budget for a short consultation with a sweepstakes-savvy lawyer instead of guessing.
